"Construction Law Developments and Issues"

Presentation Abstract:
This panel of construction lawyers from British Columbia, Alberta, and Ontario will discuss recent developments and issues to be aware of in the following areas, with a focus on "new" or "existing" construction law legislation in these three provinces:
  • Adjudication - historical data from Ontario, motions for leave/insight into the determinations and the adjudication process and practice.
  • Differences in the transition provisions in Ontario and Alberta
  • Impact "new" and "existing" construction law legislation has or may have on construction liens and trust provisions
  • Pay When Paid provisions - do they continue to exist?
  • The interplay between construction law legislation and the Federal Bankruptcy and Insolvency Act, and
  • Contract Notice Provisions - fatal to a claim or no big deal?

SANDRA ASTOLFO

Sandra Astolfo is a partner with WeirFoulds with a practice devoted to infrastructure and construction law. She has worked with her clients for over 25 years and is a frequent speaker at continuing legal education programs and industry conferences. From negotiating construction agreements, to providing contract administration advice, to litigating, mediating and arbitrating disputes. Sandra advocates on behalf of all project participants. She also assists her clients with protecting their interests in the event of a project participant's insolvency.

Sandra is a Fellow of both the Canadian College of Construction Lawyers and the Construction Lawyers Society of America. She is certified by The Law Society of Ontario as a Specialist in Construction Law and has authored numerous articles on various construction law topics

ANDREA LEE
Partner, Glaholt Bowles LLP

 

Andrea Lee is certified as a Specialist in Construction Law by the Law Society of Ontario, and is a Fellow of the Canadian College of Construction Lawyers and past chair of the Ontario Bar Association, Construction and Infrastructure Section Executive.

Andrea obtained her Bachelor of Architecture from the University of Toronto and a Bachelor of Law from Queen's University. She has practiced exclusively in construction law since her call to the bar in 2006. She acts for owners, contractors, design professionals and insurers in complex disputes involving claims for breach of contract, negligence, liens, breach of trust, cost overruns, delay and deficiencies. Andrea regularly advises parties in the industry with respect to construction contracts and professional design agreements.

Andrea is a co-founder of the construction law course at Queen's University and teaches construction law as part of Osgoode's LL.M program. Andrea regularly speaks at programs offered by the legal and industry associations, published articles and papers on construction law topics and co-authored chapters focused on design professionals in Halsbury's Laws of Canada, Construction and Review of Construction Law: Recent Developments. Andrea is the co-editor and co-author of the text. Critical issues in the Canadian Law of Architects and Engineers (Toronto: Thomson Reuters, 2023) and has also co-edited Bidding and Tendering, What is the Law? (6th edition).

PATRICIA MORRISON
Partner and National Business Leader, Construction at Borden Ladner Gervais LLP

 

Trish provides strategic advice to owners, developers, architects, and engineers for the management of risk on construction projects from start to finish. Trish has extensive experience in mediation, arbitration, and litigation of construction disputes on large-scale commercial, industrial and infrastructure projects, such as disputes involving tenders and RFPs, construction contracts, liens, design and engineering issues, construction deficiencies, cost overruns and delay.

She also advises clients on front-end project matters sich as project delivery models, tendering and other procurement processes, contract negotiation and drafting (including P3 agreements) and provides advisory services throughout projects.

Trish also advises on project-related environmental and product liability issues. She is a Fellow and the vice-president of the Canadian College of Construction Lawyers, past chair of the Canadian Bar Association National Construction Law Section, and a former director of the Calgary Construction Association. She regularly presents at construction industry and client seminars and is a frequent writer on a variety of construction law topics.
